What does “wrongful death” mean?
A wrongful death is the loss of life that results from someone else’s actions, whether intentional or due to negligence. The term covers many different situations, such as a car accident caused by a distracted driver, a doctor ignoring life-threatening symptoms, or a bar fight that went too far.
Each state has its own laws that cover wrongful death lawsuits. The laws specify who can file a wrongful death action, the types of losses that are eligible for compensation, and the deadline for filing a case in civil court (known as the statute of limitations), and other procedural details.
How long does a car accident lawsuit take?
Unfortunately, there is no simple answer for this. Depending on the specifics of the accident, the injuries, and the insurance companies involved, it can take anywhere from a few months to a few years before everything is settled.
Here are a few factors that can affect timing:
- The specifics of the accident. If the driver who caused the accident was driving their personal vehicle, the case will be settled faster than one that involved a government vehicle.
- The extent of your injuries. It’s important that you know the full extent of your injuries and the impact on your life to make sure the damages cover everything.
- The actions of the insurance companies. Each insurer has its own approval process for handling claims. We continue to push them, but certain companies take longer than others.
- Going to court. Most cases settle out of court, but if your case goes to trial, there are specific time periods in place. For example, once you file a lawsuit, the other party has 30 days to answer your claim. In general, however, these cases take longer than negotiating a settlement out of court.

Who can file a medical malpractice claim?
Our attorneys will take care of filing the legal documents required for your medical malpractice claim. From a legal perspective, though, the following parties can file a civil action for medical malpractice:
- The victim if they are an adult with the mental capacity to do so
- The victim’s parents if the victim is a minor
- The person who has power of attorney for the victim if the victim is incapacitated
- The victim’s spouse, parent, adult child, or another beneficiary if the victim is deceased
